These Terms of Service (“Terms”) govern your use of this website and any services provided by Alex Tailor, operated by Alexandra Pourvali, doing business as Alex Tailor, based in Ojai, California, USA.

1. Business Information

2. Services
Alex Tailor provides professional creative services, including but not limited to creative consulting, logo design, brand identity and brand strategy services, website design, packaging design, retail display design, and digital organization services. Services may be offered as one-on-one sessions or as project-based engagements. Alex Tailor reserves the right to decline or discontinue work with any prospective or existing client at her discretion.

3. Payments and Billing
Clients agree to pay all invoices according to the terms outlined in their proposal or contract. Payments may include deposits and installment payments. Payments are non-refundable once project work has begun. Late payments may result in late fees. Alex Tailor reserves the right to pause or suspend work if payment is not received on time. Prices are subject to change without notice.

4. Intellectual Property and Ownership
Ownership of final design deliverables transfers to the client only after full and final payment has been received. Until payment is complete, all work remains the property of Alex Tailor. Alex Tailor retains the right to display completed work in professional portfolios, share completed work on social media, and use completed work for self-promotion and marketing purposes. Licensed fonts, stock imagery, or third-party assets may be used during a project. Clients are responsible for purchasing their own licenses when agreed upon. Alex Tailor is not responsible for misuse of fonts, imagery, or assets by the client outside the scope of licensing.

5. Revisions and Scope
Project-based services include a defined number of revisions as outlined in the project agreement. Requests outside the agreed scope will be billed at an hourly rate. Expanded scope may require additional fees or a revised agreement. Work will not continue outside scope without client approval.

6. Client Responsibilities
Clients are responsible for providing all required content, images, and feedback by the deadlines outlined in their project agreement. Delays in client communication may impact project timelines. Alex Tailor reserves the right to pause or close a project due to prolonged lack of communication.

7. Cancellations and Termination
Either party may terminate a project agreement at any time. If a client cancels mid-project, they are responsible for payment for all work completed up to the date of cancellation. Completed payments are forfeited upon cancellation. Misuse, abuse of the agreement, or failure to pay invoices within the agreed timeframe may result in a formal demand letter. If necessary, claims may be filed in California small claims court.

8. No Guarantees and Limitation of Liability
Design outcomes are subjective. Alex Tailor does not guarantee business results, sales, revenue, or performance outcomes. To the fullest extent permitted by law, Alex Tailor is not liable for lost profits or business opportunities, technical issues or website downtime, third-party platform changes (including but not limited to Squarespace, Canva, Meta, or other software providers).

9. Errors and Omissions
While Alex Tailor makes every effort to provide accurate, thoughtful, and professional work, we are not responsible for errors or omissions that result from inaccurate, incomplete, or delayed information provided by the client. We are also not responsible for errors arising from content, images, copy, or materials supplied by the client or third parties, changes made by the client or third parties after final delivery, or platform updates, software changes, or technical limitations beyond our control. Clients are responsible for carefully reviewing and approving all deliverables before final use, and approval constitutes acceptance of the work as delivered.

10. Indemnification
You agree to indemnify, defend, and hold harmless Alex Tailor, operated by Alexandra Pourvali, as well as any affiliated contractors, subcontractors, consultants, vendors, and service providers engaged in connection with a project, from and against any and all claims, demands, damages, losses, liabilities, judgments, costs, or expenses, including reasonable attorneys’ fees, that arise out of or relate to your use of the website or services, your breach of these Terms, your misuse or modification of any deliverables, or your violation of any applicable laws or regulations. This includes, without limitation, any claims arising from materials you provide that infringe upon the intellectual property, privacy, or other rights of a third party, as well as any claims related to the manner in which the final work is implemented, distributed, or used by you or on your behalf. This indemnification obligation survives the completion, termination, or expiration of any services provided by Alex Tailor.

11. Website Use and Intellectual Property
All content on www.alextailordesign.com, including text, designs, graphics, and images, is the intellectual property of Alex Tailor unless otherwise stated. Users may not copy or reproduce site content, replicate designs or written material, or misuse intellectual property found on this website. This website may only be used for lawful purposes.

12. Prohibited Uses
You agree to use this website and any services provided by Alex Tailor only for lawful purposes. You may not copy, reproduce, distribute, or exploit any website content without permission, nor may you replicate, resell, or misrepresent ownership of designs, templates, or written materials created by Alex Tailor. You may not use any deliverables in a misleading, deceptive, or illegal manner, interfere with the functionality or security of the website, or engage in conduct that harasses, abuses, or harms Alex Tailor or others. Any violation of these Terms may result in termination of access to the website or services and, where appropriate, legal action.

13. Governing Law and Dispute Resolution
By agreeing to these Terms, you acknowledge and agree that any dispute, claim, or controversy arising out of or relating to your use of this website or services provided by Alex Tailor will be resolved on an individual basis. You waive any right to a trial by jury and agree not to participate in any class action, collective action, or representative proceeding. If any portion of this section is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
