These Terms of Service (“Terms”) govern your use of this website and any services provided by Alex Tailor, operated by Alexandra Pourvali, doing business as Alex Tailor, based in Ojai, California, USA.

By accessing this website or engaging Alex Tailor for services, you agree to be bound by these Terms.

1. Business Information
Alex Tailor is a design and consulting business operated by Alexandra Pourvali (“we,” “us,” or “our”). This website is used for lead generation and the sale of creative services.

2. Services
Alex Tailor provides professional creative services, including but not limited to creative consulting, logo design, brand identity and strategy, website design, packaging design, retail display design, and digital organization services. Services may be offered as one-on-one sessions or as project-based engagements. Alex Tailor reserves the right to decline, discontinue, or terminate work with any prospective or existing client at her discretion.

3. Payments and Billing
Clients agree to pay all invoices according to the payment terms outlined in their proposal or contract. Projects may require deposits and installment payments. Payments are non-refundable once project work has begun. Late payments may result in late fees, and Alex Tailor reserves the right to pause or suspend work until payment is brought current. Prices and service offerings are subject to change without notice.

4. Intellectual Property and Ownership
Ownership of final design deliverables transfers to the client only after full and final payment has been received. Until payment is complete, all work remains the intellectual property of Alex Tailor. Alex Tailor retains the right to display completed work in professional portfolios, on social media, and in other marketing or promotional materials. Licensed fonts, stock imagery, or third-party assets may be used during a project. Clients are responsible for purchasing and maintaining appropriate licenses when agreed upon. Alex Tailor is not responsible for misuse of fonts, imagery, or assets outside the scope of licensing.

5. Revisions and Scope
Project-based services include a defined number of revisions as outlined in the project agreement. Requests outside the agreed scope will be billed at an hourly rate or may require a revised agreement. Work outside the agreed scope will not continue without client approval.

6. Client Responsibilities
Clients are responsible for providing all required content, assets, and feedback by the deadlines outlined in their agreement. Delays in communication or approvals may impact project timelines. Alex Tailor reserves the right to pause or close a project due to prolonged lack of communication.

7. Cancellations and Termination
Either party may terminate a project agreement at any time. If a client cancels mid-project, the client is responsible for payment for all work completed up to the date of cancellation. Any payments made are forfeited and will not be refunded. Misuse of services, breach of these Terms, or failure to pay invoices within the agreed timeframe may result in a formal demand for payment and, if necessary, legal action. Claims may be filed in California small claims court when applicable.

8. No Guarantees and Limitation of Liability
Design outcomes are subjective. Alex Tailor does not guarantee specific business results, sales, revenue, or performance outcomes. To the fullest extent permitted by law, Alex Tailor shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits or business opportunities, website downtime, or third-party platform changes (including Squarespace, Canva, Meta, or other software providers).

9. Errors and Omissions
While Alex Tailor makes every effort to provide accurate and professional work, we are not responsible for errors or omissions resulting from inaccurate, incomplete, or delayed information provided by the client. We are also not responsible for errors arising from materials supplied by the client or third parties, changes made after final delivery, or platform updates and technical limitations beyond our control. Client approval of deliverables constitutes acceptance of the work as delivered.

10. Indemnification
You agree to indemnify, defend, and hold harmless Alex Tailor, Alexandra Pourvali, and any affiliated contractors, consultants, vendors, or service providers engaged in connection with a project from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the website or services, your breach of these Terms, misuse or modification of deliverables, or violation of applicable laws. This includes claims related to materials you provide that infringe upon third-party rights or the manner in which the final work is implemented or used. This obligation survives termination or completion of services.

11. Website Use and Intellectual Property
All content on www.alextailordesign.com, including text, graphics, and designs, is the intellectual property of Alex Tailor unless otherwise stated. You may not copy, reproduce, distribute, or exploit any website content without written permission. This website may only be used for lawful purposes.

12. Prohibited Uses
You agree not to misuse this website or any services provided by Alex Tailor. Prohibited conduct includes copying or reselling content or deliverables, misrepresenting ownership of creative work, using deliverables in a deceptive or illegal manner, interfering with website functionality, or engaging in harassing or abusive behavior. Violations may result in termination of access and potential legal action.

13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California. Any dispute arising out of or relating to these Terms or services will be resolved on an individual basis. You waive the right to a jury trial and agree not to participate in any class or representative action. If any portion of this section is deemed unenforceable, the remainder shall remain in effect.
